Preface

Welcome to Paris-Sharing.com, the Web site operated by the PlanetSharing Company SAS (hereafter referred to as “the Company", ” “we,” “us,” or “our”), registered in Paris. PlanetSharing SAS maintains www.Paris-Sharing.com (hereafter "Site"), as a service to our users and visitors (our Site and such services, collectively, our "Services"). By using this Site, you agree to comply with and be legally bound by the following terms of use ("Terms"), whether or not you become a registered user of the Services. Please review the following terms carefully. If you do not agree to these terms, you have no right to obtain information from or otherwise continue using this Site. Failure to use this Site in accordance with the following terms of use may subject you to severe civil and criminal penalties. We reserve the right to modify these Terms or policies relating to the Services at any time, effective upon posting of an updated version of these Terms on the Site. You are responsible for regularly reviewing these Terms. By using this Site, you agree that the posting of new or revised terms and conditions on the Site will constitute adequate and constructive notice to you of any and all revisions and changes. Continued use of the Service after any such changes or after explicitly accepting the new Terms upon logging into the site shall constitute your consent to such changes.

The services offered

There are four kinds of services offered through the Site :

☯ A social network that allows members to share personal information with the intent of fostering trust.

☯ Online reservation and payment, transaction assistance, insurance, and customer satisfaction assurance.

☯ Assistance in welcoming tourists and in managing check-in and check

 

Part I - Terms of Use


1 – Access

1.1 Public access

Access to some of the website's content, such as the accommodation listing and tourist information, does not require personal identification.  All use of publication and reservation services, including access to information about members, requires personal identification. Any access to such information without authorization is considered  an infraction and is subject to civil and criminal penalties.

1.2 - Member access

To use the services provided by the Site, you are required to create a user account, which entails the following :

- choosing a login  (in the form of an email address and a password).

- agreeing to the Member Charter

- agreeing to the present terms of use and of sale

- creating a bona fide user profile that will be used to present you to other members.

Your login and password are strictly confidential and you are expected to take all necessary measures to maintain their confidentiality. The Company shall not be held accountable for any fraudulent use of such information. You therefore accept that all actions performed using your personal login will be attributed to you. All transactions that you may authorize on the Site, such as a rental agreement or a subscription, are considered as signed-off by you.

If you forget your password, you can create a new one following the instructions on the website. You can also modify your login at any time, following the same procedure.

The Company reserves the right to delete a user profile, unilaterally and without notice or indemnity, in the case of a manifest violation of the present terms.

Any person above the age of 18 can become a member on the website.

 

2 - Personal Information and Confidentiality

The nature of the information requested

Personal information is requested for the sole purpose of creating confidence among people who wish to rent or exchange their house / apartment, or host tourists in their guest room. This information is visible on the Website by other members. Certain information is visible to both parties to a transaction. For example, the  telephone number and address will be sent to each party once the lease is  validated to allow both parties to agree on practical arrangements for the rental.

The information provided by the member in his profile will be retained by the Company operating the Site, which will provide personal information as part of the services it offers. However, the Company agrees not to disclose to third parties any data registered to its Members except  that required for service obligation or legal duty.

The information requested of members are similar to those commonly required by social networking sites. These include name and surname, date of birth, city of residence, nationality, marital status, other social networks to which he / she is a member, personal website / blog, languages spoken, hobbies / recreation etc.

Under the French Data Protection Act of January 6, 1978 . Members have a right  to access and to modify their data at the following e-mail: admin@Paris-Sharing.com

Data Privacy

Some sections of the Site require you to enter personal information so as to enable:

☯ connection between members offering and those looking for accommodations,

☯ the creation of e-mail alerts,

☯  sending e-mail with information about the website's services,

☯ address location and verification.

We take all possible measures to maintain the confidentiality of our member's personal information. We will not disclose to third parties any information or details provided by members. Contact forms used by members to request information or make a booking with an owner are only available to that owner. Should such information be illicitely intercepted by others, we cannot be held responsible.

By subscribing to a newsletter,  members have the opportunity to receive information enabling them to better use the site and find the best deals available. Subject to obtaining such consent, the Company may be called upon to transfer data on Members to third party companies, including its partners.

In accordance with the French law dating from January 6, 1978, we inform you that you have a right of access, modification, rectification and deletion of your contribution to this Internet service. To exercise this right, you can change your information directly on the website in the space called "My Account". In case of any problems encountered, you can send an email to admin@Paris-Sharing.com mentioning in the subject line "Data Protection Act".

Cookies

Cookies used by the Company are in no way used to collect personal information on visitors. The Company uses temporary cookies (session cookies are not stored) for help navigating the site. If the member chooses to reject all cookies (including temporary cookies), he will not be able to access and update his account correctly.

Statistics

The Company reserves the right to undertake studies and statistical analysis on the type of site users.The Company may eventually disseminate aggregate results of this analysis, with no personally identifiable information.

 

3 - Using the Internet

Internet Security

Given the risks associated with specific technical features of  the Internet, the Company can not guarantee that information exchanged via the Site will not be intercepted by third parties.

Disclaimer Links to Third Party Sites

The Site may contain hypertext links or other promotional formats (logo, banners, videos ....) to websites operated by third parties. The Company is does not necessarily endorse all content that can be found on such sites, and in no way can be held liable for such content. In addtion, the Company does not provide any warranty regarding:

☯ the accuracy, timeliness, quality, completeness and comprehensiveness of the content of websites indexed;

☯ relevance and completeness of websites indexed;

☯ difficulties of access and operation of these websites.

The Company will not be held liable in a dispute between a commercial site indexed on the site and one of its users. The operators of commercial sites referenced by the Company are solely responsible for compliance with all regulations relating to products or services offered to users, including laws and regulations relating to:

☯ d istance selling,

☯ consumer protection,

☯ misleading advertising

☯ deceptive prices, compliance products and services,

☯ regulations specific to products and services considered.

 

Protection of persons and property

The user agrees not to use the Company's website for illegal purposes and in particular, not to broadcast message (s) or information  whatever their form or nature. These include, but are not limited to information that is contrary to public order or morality, contrary to respect for privacy, abusive, defamatory, racist, xenophobic, revisionist or detrimental to the honor or reputation of others, inciting discrimination, hatred ; threatening a person or group of persons;  pornographic or pedophile;  incitement to commit a criminal offense or an act of terrorism or the glorification of war crimes or crimes against humanity;  inciting suicide ; violating the law on secrecy of correspondence, or, in general, contrary to a regulation or law.

The user further agrees not to use the services offered by the Company or the personal data which it accesses for linking purposes of trade in general,  or to offer products and services either directly or indirectly ; not to restrict in any way whatsoever use of the Site, nor to falsify any statement or item of this site;  not to infiltrate a computer sys tem, not to alter the content, or commit any offense punishable by articles 323-1 to 323-7 of the Penal Code ( "hacking"), not to  send unsolicited messages to the mailboxes of other users ( "spamming"), a "> s condemned  by Article 226-18 of the French Penal Code.

In any event, the Company will not be held liable for information posted on its website by others.

Illegal content

Anyone wishing to inform the Company of the presence of information or illegal content may inform the latter in writing to admin@Paris-Sharing.com indicating the subject "illegal content". Under the terms of Article 6-I-5 of Act No. 2004-575 of 21 June 2004 on confidence in the digital economy, the notification must include all the following information:

☯ the date of notification;

☯ the identity of the notifier's name, occupation, residence, nationality, date and place of birth;

☯ the name and address of the recipient;

☯ description of the facts and the exact location (eg URL of the advertisement in question);

☯ the reasons for which the contents must be removed, including the reference of the legal and factual justification;

☯ copy of correspondence with the author or publisher of information or business issue requiring interruption, withdrawal or modification.

Moreover, under the provisions of Article 6-I-7 of the Act of June 21, 2004, The Company offers users  information (when it is aware) of any illegal data for condoning crimes against humanity, incitement to racial hatred and child pornography, or incitement to violence and violations of human dignity.

 

4 - Intellectual property protection and related rights

Some items (including editorial, graphics and illustrations) contained on the Site are protected by the law of intellectual property. Any publication, reproduction or redistribution, both in France and abroad of all or part of the contents of the site and its component parts is prohibited.

The contents published by the Company are protected by copyright. Any copy or partial copy, in particular for advertising purposes is prohibited. Any other reproduction, publication or distribution is prohibited and may result in civil and / or criminal charges of the author (Article L. 335-2 from the Frenc Intellectual Property Code).

The trademarks of the web site operator and its partners, and logos appearing on the site are trademarks semi-figurative or not, and are protected.. Any total or partial reproduction of these brands or these logos made from elements of the site without the express permission of the operator of the website is prohibited by Article L.713-2 of the Code of intellectual property.

5 - Unauthorized access

You agree not to use software or manual process to copy our web pages or to save or collect information on these pages without our express prior written consent. You agree not to use devices or software of any kind to interfere or attempt to disrupt the smooth operation of our site. You agree not to take any action that would impose a disproportionate burden on our infrastructure. Most of the information contained on our website is updated in real time and is given a license by our members or third parties. You agree not to copy, reproduce, alter, modify, create derivative works, or publicly disclose all or part of the content of our Site without our prior consent in writing or that of third parties.The general structure, as well as software, text, images, animated images, sounds, know-how and all other components of the site are the exclusive property of the Company.

6 - Action in case of infringement

Termination

We reserve the right to temporarily or permanently suspend your membership, terminate and cease to provide our services in the following cases, whether you have contributed financially or not to PARIS-SHARING.COM, if you violate any or all of these Terms & Conditions, or if we are unable to verify or authenticate any information you provide, and you do not respond to our requests for authentication, or if we believe that your actions are likely to lead to liability for you, us, or members.

Compensation

You agree to compensate the Company (including the reasonable attorneys' fees) and other group companies, corporate officers, directors, agents and employees against any claim made by a third party caused or resulting from a your breach  of these Terms or any document incorporated by reference, or your breach of any law or rights of third parties.

Part II - Terms of Sale


7 - Description of Services

Publishing of and access to accommodation offerings

The site allows you, as an owner, to publish information about you and your accommodation(s) directly on the Site.

You are responsible for the accuracy of the information you provide concerning yourself and your accommodation offering. You authorize the Company to use the photos posted online for commercial purposes, but may request in writing that the Company withdraw this permission in respect a specific image.

The Company will in no case be liable for any discrepancy between what is shown and what is provided. Any conflict should be resolved directly between members. The Company may propose arbitration at the request of one or both parties and will, in all cases, seek to reach a fair agreement.

Where appropriate, the Company reserves the right :

- to verify the accommodations and / or the identity of the resident on the IP addresses used by the resident.

- to withdraw a listing from its site, without refund, if such listing has been made by a business not having identified itself as such,

- to prevent access and / or remove from its website (without reimbursement and indemnity) ads for vacation rental or bed and breakfasts that do not respect the terms of the Site, including but not limited to insufficient descriptions, failure to respond to reservation requests, misuse of services including modification or updatingd more than 60 times per month.

- to remove members who do not adhere to the Terms of Service.

Should a listing be withdrawn for one of the reasons cited above, the Company reserves the right to collect the annual subscription price and any other fees due.

Social Network Services

The site offers social networking features to facilitate the development and operation of the online community. This feature allows members to provide personal information  such as professional activities, hobbies, interests, photos, etc.. Such information is provided by the member and may be modified at any time, directly on the site. The profile information of the member is  available to other members. Personal address and telephone information is only shared after a booking has been made between two members.

Booking Services

The site facilitates and secures transactions between individuals of different languages, cultures, currencies , banking systems, and legal systems. To do this, it offers the tourist  the opportunity to make all transactions (deposit, security deposit, balance) on line with his credit card (or Paypal account).

The Company is not a party to the rental contract, but provides the online booking service. Thus, each vacation rental, home exchange, and guest room  results in a specific contract between the members. Any dispute concerning the non-enforcement of a clause in the contract will be settled between the two parties to the contract. The Company may provide arbitration at the request of either party, but is in no way responsible for any breach of contract.

Bookings are finalized online, after both parties have accepted the Company's sales terms and the terms of contract between them.

To facilitate transactions between its members, the site offers a contract for both parties that includes their personal data. To expedite the process, you grant us the right to proceed with the transaction after receiving the simple electronic agreement of both parties. The act of checking a box provided for that purpose after the posting of the contract is considered as an electronic agreement. You agree that the data stored by the website concerning your reservation will be considered authoritative. Such data are admissible under the same conditions and with the same value of material proof as any document to be prepared, received or retained in writing.

Online payment

The site offers a complete online booking & payment process. This procedure is detailed in chapter 8. You can perform all operations on line with your credit card (or Paypal account). These operations are of three types (A, B, C) and are usually completed in three stages:

  1. Payment of a deposit at the time of booking (A) and pre-authorization to debit the balance (B)
  2. Payment of the balance (B) before entering the premises and pre-authorization for the security deposit (C),
  3. At the end of the stay and following the inventory, release of the security deposit authorization (except in the case of damages).

Card payments are processed through the secure banking system provided by  CM-CIC. All credit card data is immediately encrypted and is neither recorded on the Site nor visible to any third party.

By using the Site to make a reservation, you authorize  the Company to charge your credit card or your Paypal account the amount indicated on the summary page of your reservation. You are not allowed to cancel your payment, unless you are certain that your credit card details have been lost or stolen.

The Company is licensed to hold an escrow account. It receives payment from travelers by credit card, then pays the owner amount due via bank wire.

8. Terms applicable to travelers

Booking

On Paris-Sharing.com you can find, reserve, and pay for your accommodation in just a few secure steps.

1. Use our search functions to find the right accommodation for you. Check that it is marked available for the dates you require and click on Reserve.

2. Register yourself on the website (you will be prompted to do so). Your registration is required for all reservation requests (Paris-Sharing doesn't work incognito). You will receive an email confirmation with a link to click on in order to activate your account.

3. Complete your reservation form with the required information about your trip (number of persons travelling, special needs,...)

4. Your request is sent directly to your host who must confirm availability within 48 hours at the latest. During this period, he may ask you for additional information about yourself or your trip.

5. If the accommodation is confirmed as available, you will receive a summary of your order that can be modified or cancelled directly on the website. To validate your reservation, you will be requested to make an advance payment of 30% (or 100% if you choose to benefit from total cancelation flexibility). The downpayment must be made by credit card, Paypal, or wire. You will also be asked to provide authorisation to debit your card  for the remaining amount of your stay as well as a security deposit. These amounts are not debited up front.

You do not have any advance payment to make for a home exchange, but are required to pay the subscription price for listing your home on the website.

6. Confirm your trip, including all relevant travel details, at least  five days prior to arrival. The remaining amount of your payment will be debited (if you paid by credit card) and you will be sent a receipt along with all the details concerning your host and your accommodation.

7. Upon arrival, you will be welcomed by the host or his representative. Paris-Sharing provides owners with a network of "Paris Greeters" (Paris and surrounding areas only). The welcome involves three steps :

-  We'll meet you at the place of your choosing: the airport, train station, or directly at the accommodation.

-  We'll give you a tour of the accommodation, with explanations if necessary on how to use the amenities. You will be given an arrival inventory on which you can make any observations.

- We'll confirm any additional services you may have ordered, hand you over the keys and wish you the best of stays!

8. At the end of your stay, we'll arrange a check-out with you and your host or his representative as a necessary formality to insure that everything is in good shape, as it was left to you.

Payment

All payments are made directly on the Site by credit card or via PayPal.

You may also pay, in whole or in part any lease using his credit points "Parishares". Upon payment, you must specify the number of points you wish to use to reduce the amount due.

Once the reservation is confirmed, you agree to pay any amount owed to the Company as scheduled.

For a rental or guest room:

-  You decide at the time of  booking to pay either 30% of the total sum as a deposit, or 100% in return for flexibility in case of cancellation (see Cancellation Terms)

- The balance must be paid before arrival.

For a home exchange, you pay the amount of subscription upon booking.

Cancellation policy

You may cancel your reservation and get your money back in part or in full provided you pay entirely for your stay at the time of booking. The amount you'll be reimbursed depends on how long before your scheduled arrival you cancel :

More than 30 days before the trip: 100%

Less than 30 days before the trip: 70%

If you pay only a deposit of 30% at the time of booking, this amount will not be refunded if you cancel. The balance that  you settled 5 days before your arrival will be reimbursed according to the rule cited above.

We also provide special cancellation insurance at a minimal cost.

 

Vacation rental agreement

Duration of the rental

Under no circumstances can the stay be extended without prior written approval of the Owner. The total duration of the contract may not extend beyond a maximum of 80 days from the initial date of occupation.

Rent/Expenses

The Renter has agreed to pay a price per night, all expenses included, displayed on the Paris-Sharing.com website at the time of reservation.  Both parties have agreed that this amount will be settled via the Paris-Sharing.com payment system according to its terms and conditions.

The renter has been given the option to make a partial downpayment (30%) upon reservation, or to settle the amount in full. In the case of a partial downpayment, any remaining balance must be settled five days prior to arrival. Failure to do so may result in cancellation of the reservation.

The Renter acknowledges receipt of a payment confirmation for payments already made.

Cancellation

Both parties agree to adhere to the Paris--Sharing.com cancellation policy, which entitles each party to partial indemnity. Details of this policy are included in the terms and conditions, available on the Paris-Sharing.com website.

A renter who terminates the rental prior to the departure date listed above shall not be entitled to a refund unless the owner has committed a serious offence or misrepresented the apartment.

Insurance and liability

The Renter is not responsible for any damages caused by events beyond his control (fire, water, intrusion); however, he remains entirely responsible for damages directly caused by his own action. As such, he agrees to compensate the Owner for any such damages. The amount of compensation is equivalent to the lesser of cost of repair or replacement.

In addition, French law requires the Renter to carry liability insurance that covers accidental damages caused to the rented property. If the Renter does not already carry such insurance, Paris-Sharing.com can provide an insurance contract specifically for the length of the stay. It is the responsibility of the renter to be able to provide evidence of appropriate coverage.

The Owner declines responsibility for damage or theft of the borrower’s personal items.

Security Deposit

The Renter authorizes Paris-Sharing.com to secure a deposit authorization equal to four times the price per night, with a minimum of 500€. Some or all of this deposit may be used in case of any damages caused by the renter to the apartment or to any of its furnishings during the stay.

The deposit authorization will be dropped, at the latest,  two weeks following departure, provided the Owner and the Renter agree that no damage has been caused.

In the case of damage or missing items, the Owner will withhold the amount deemed necessary for repair or replacement, based on material evidence. If the actual amount for the repairs is less than the estimate, the Renter will receive reimbursement for the difference. Some damages may be covered by the Renter’s insurance policy, and will be reimbursed according to the terms of that policy.

As it is expected that the apartment be rendered clean (waste bins emptied, dishes, appliances and toilets cleaned), the amount of 25€ or 50€ may be deducted in case any or several of these tasks have not been carried out, and / or if the premises are left requiring more than standard housecleaning.

Check-in and check-out

In order to avoid misunderstandings about any damages observed by the owner after the renter’s stay, both parties will sign a document upon arrival that describes the state of the premises and the inventory of available furnishings. If necessary, this document will serve as a reference upon check-out.

Standard check-in time is 3pm and check-out time is 11am. Other times are possible, in agreement with the Owner.

General Conditions

The renter agrees to adhere to the following conditions:

  • The apartment is not to be used for commercial purposes
  • The renter will make every effort not to disturb the neighbours (noise, trash, smoke, etc...)
  • The renter may modify neither the apartment nor the furniture
  • The renter authorizes the Owner to perform emergency repairs during the duration of the agreement without requesting any indemnity.

The competent judicial tribunal associated with the apartment location will preside over any litigation.



9 - Terms applicable to owners

Payment of income

By accepting these terms, you mandate the Company to collect rental or other income on your behalf, through its online payment system.

In agreement with you, we set a cost per night that represents at least 150% of what you would normally receive in terms of rental income if your apartment were permanently rented. We calculate the cost per night based on an index of going market rates, neighborhood by neighborhood, provided by public sources such as Meilleuragent.com (for France).

The prices displayed on our site are above the amount of your remuneration, to take account of the cost of our services.

We pay you at the end of the stay, less the amount of your annual subscription (for the first transaction of the year) and less any cost of additional services provided.

We offer several methods of payment :

  1. Payment of the sum from directly to your bank account the first business day of the month following the last day of rental. This is the method of payment default.
  2. Delayed payment of the sum for the purpose of tax optimazation, upon request
  3. Converting the sum due into credit points, either entirely or in part, with the possibility of payment for the remaining amount in cash (see Section 5)

Subscriptions

Two subscription packages are offered: Basic and Optimum. Services (a) included for each formula are shown below. Services (b) the preparation, development and relationships are open to tourists for two categories of subscribers, but are not (yet) available only to residents in Paris and some other localities. The customer is informed of his eligibility for these services at the time of acceptance of an accommodation.

The price of this subscription is payable from the time that the resident publishes an accommodation on the site and accepts the Terms of Use. However, if the resident fails to allocate anything at this point,  no  fee is levied and the amount of the subscription will simply be deducted from future earnings. If, after 18 months from the publication of the announcement, no transaction has occurred, the resident will have the choice to pay the subscription to maintain its listing on the Site, or to withdraw with no debt to the Company.

Owner commitments

Commitment on response time

You agree to meet each reservation request as soon as possible, and most under 42 hours or the request  may be canceled. Three answers are possible:

- Confirmation of availability and acceptance of the transaction.

- Request for additional information or request additional time to confirm availability or to arrange

-Withdrawal of availability

In the case of a request for additional time, its duration should be specified to the member who made the reservation request. He need not await the response before making further applications. As a courtesy, each party will inform the other of a change that could affect it.

Commitment to rental agreements

You agree contractually to provide your housing for the period specified.

If for personal reasons (force majeure or other), you are no longer able to honor your contract, you will be liable to pay compensation, which varies depending on time of cancellation prior to stay.

☯ For cancellations> 30 days before the start of the stay, compensation will be 10% of rental sum

☯ For cancellations <= 20 days before the start of the stay, compensation will be 20% of rental sum

The compensation will first be deducted from your credit point account (P $), before being deducted from income on future rentals.

Commitment to a fair price

The resident has the right to change its earnings upward or downward at any time.  However. increases of the price displayed on the site take full effect in terms of loss of potential customers.

The site promises its members accommodation with value for money unbeatable: the "Paris-Sharing Value Guarantee".member traveler who finds another site accommodation comparable at a lower price for the same period may request a refund of the difference.

As a result, the Company's  resident members are requested to establish a competitive price. The rebate granted to the member traveler will be deducted from future earnings of the resident  if he demanded a higher price than that advised by the Company.

The Company shall make refunds wisely in the interest of all parties. It is in the interest of the Company and its resident members to adjust its prices according to market supply.

Commitment to quality service

In addition to its adherence to the Charter of Values as the Member, the resident agrees to observe:

- The conditions of the particular contract made with the traveler member

- Instructions for a quality service provided on this Site

Both documents are made available to the member in his personal space.

Excellence is rewarded by the discernment of the label "Paris-Sharing Hospitality Excellence Seal"

Commitment to fair business

It is expressly forbidden to use the Website to promote an accommodation offering with the intent to circumvent the subscription or other service fees normally due to the Company. If you refuse more than three reservation requests for different periods, we reserve the right to delete your listing. If the same apartment or guest room is named on one or more third-party sites, and if you use our site to direct potential customers to any third party site to avoid the payment of our services, you will immediately owe the sum € 200 per listing. However, if you make at least one transaction on our site per year, no compensation will be sought for transactions on third party sites.

10 - System of credit points (P $)

It establishes a system of credit points (hereinafter referred to as "PariShares and P $" to retain customers of PariSharing. Each transaction on PariSharing produces PariShares on behalf of those who completed the transaction.

The PariShares can be used by the client to purchase benefits, in part or in whole, on the site PariSharing.

A P $ equals 1 €.

Earning  "PariShares"

You can get award PariShares several ways: A resident who reached the best rating receives an additional $ 10 P after each transaction.

1. For every transaction each party earns 10 P $ provided each is satisfied with the other's performance.

2. A resident member will receive  20 P $ whenever it chooses, either:

- For a deferral of payment of amounts owed to the following year;

- The conversion of these are(1 Euro = $ 1 P $

3. You save 10 P $  whenever you refer a new member, after the first transaction of the referred person. A new member who does not conclude the transaction does not qualify for PariShares.

4. A Member traveler who is granted a refund under the "Guarantor Paris-Sharing Value" will be awarded  2  P $ instead of every euro agreed.

5. The resident agrees to hire a home exchange with another member whose rental value of the house would be less, will receive double compensation due for P $ by Euro difference.

6. Whenever you agree to provide a reception service, delivery of key and inventory on behalf of another member, you earn 30 P $. If you do the service at the arrival or departure, you win $ 20P.

The maximum number of PariShares awarded per year is capped at 150 per Member. The PariShares are cumulative from year to year and are valid for ten years. The ten members having the largest number of PariShares will be placed on the " Site Recognition "(subject to acceptance by the Member).

Use of "PariShares"

Several possibilities are proposed for use PariShares.

You can use your P $ to buy benefits, in part or in whole, on the Paris-Sharing.com. You can, provided you have subscribed to option Optimum, use your P $ to  pay , in whole or in part, for subscription or service fees.

If  you are  subscribed to Optimum option, you can at any time request the payment of your P $ to euro, but only the part you are owed for the rental or as delivery room host. This payment does so that clients residents.

Customers who meet eligibility criteria may convert their P $ to shares of the Company, subject to the approval of the community partners.

11 - Owner compensation

The amount of income to which the owner is entitled  is shown on the form of description of the apartment, accessible at any time http://www.paris-sharing.com/my/offer/. This amount is set by mutual agreement with the owner and may be revised upward or downward by the owner himself.

Subscription

The publication of a home listing ont the website constitutes a subscription. The amount of the annual subscription is deducted from the first transaction of the period.

Members may, with a single accommodation, offer rental and / or exchange and / or a guest room for the price of only one subscription provided that they choose the Optimum option. Otherwise, each additional accommodation offer is charged at € 40 per year. The same rule applies to multiple accommodations: up to 5 accommodations are included in the Optimum option. Otherwise, each additional accommodation will be charged € 40 per year.

Loyalty benefits

Owners who rent more than 30 nights per year receive a premium. The amount of the premium depends on the number of nights rented in the year. It is calculated on the average of rent paid to the owner during the year.

The premium only applies to the number qualifying nights. For example, for an apartment rented 122 days, the premium of +18% will apply to 2 nights, and the premium of +12% will apply to 89 nights.

 

12 - Rates applicable to travelers

When you use our Site to book and pay for accommodations, the price you pay includes the accommodation's cost price plus a service charge to cover international online payment, insurance, and administrative costs. This price includes all taxes.

Service charges are included in the price displayed on the Site for the most common length of stays (3 to 6 nights). Rates are reduced for stays longer than 6 nights , and increased  for stays shorter than 3 nights. The increase or reduction is calculated on the total price of the accommodation (prices per night X number of nights) as shown in the table below :

The rate is increased by 5% per supplementary guest. A guest is considered supplementary if the displayed welcome capacity is exceed. For example, an apartment advertised for 4 persons will incur a 5% surcharge for the fifth guest. A flat-rate reduction of 5% is applied if the number of guests is less than the displayed welcome capacity.

13 - Rates applicable to home exchanges

Home exchanges incur no transaction costs. Each exchange partner must pay the subscription amount according to the option he/she has chosen. There are no service charges. If both houses are proposed on the site with a rental price, the price difference qualifies the member to receive loyalty points. The home that is of greater rental value entitles its owner to receive  2 P$ (PariShares) per euro of price difference.

Example :

A town house in San Francisco displays a price / night 140 €. An apartment in Paris displays a price / night 120 €. The requested stay is 15 nights.

Each member pays an annual subscription at the time of booking. The difference in price / night  of 20 € allows the host in San Francisco to win $ 40 P $ (see PariShares).

 

14 - Jurisdiction

We will do our best to amicably resolve any dispute. If you are not satisfied by the mode of settlement and want to appeal to a court, we specify that the contract is governed by French law. Each party gives exclusive jurisdiction for any dispute to the courts of Paris.
