Vacation Rental Agreement

 

Between the undersigned:

Hereby referred to as the “Owner”

And

Hereby referred to as the “Renter”

This agreement refers to the rental of a furnished apartment as designated below:

A detailed presentation of the apartment, amply illustrated by photos, is accessible on the website www.Paris-Sharing.com. The Renter acknowledges that he has reviewed this presentation and accepts it as a material basis for the present contract.

Duration of the rental

 

The current rental agreement is valid for a stay of _  nights

from (date to date).

Under no circumstances can the stay be extended without prior written approval of the Owner. The total duration of the contract may not extend beyond a maximum of 80 days from the initial date of occupation.

Maximum occupancy

The maximum number of guests is limited to the number specified at the time of booking. No additional guests are allowed without consent of the owner or agent.

Rent/Expenses

The Renter has agreed to pay a price per night, all expenses included, displayed on the Paris-Sharing.com website at the time of reservation. Both parties have agreed that this amount will be settled via the Paris-Sharing.com payment system according to its terms and conditions.

The Renter has been given the option to make a downpayment (30%) upon reservation, or to settle the amount in full. In the case of a downpayment, any remaining balance must be settled five days prior to arrival. Failure to do so may result in cancellation of the reservation.

The Renter acknowledges receipt of a confirmation for payments already made.

Cancellation

Both parties agree to adhere to the Paris-Sharing.com cancellation policy, which entitles each party to partial indemnity. Details of this policy are included in the Paris-Sharing.com terms and conditions.

A renter who terminates the rental prior to the departure date listed above shall not be entitled to a refund unless the owner has committed a serious offence or misrepresented the apartment.

Insurance and liability

The Renter is not responsible for any damages caused by events beyond his control (fire, water, intrusion); however, he remains entirely responsible for damages directly caused by his own action. As such, he agrees to compensate the Landlord for any such damages. The amount of compensation is equivalent to the lesser of cost of repair or replacement.

The renter should verify his/her personal liability insurance in case of damages caused to rented property in France. Should no such coverage exist, ParisSharing can provide an insurance contract specifically for the length of the stay. It is the responsibility of the renter to be able to provide evidence of appropriate coverage.

The Owner declines responsibility for damage or theft of the renter’s personal items.

Security Deposit

The Renter authorizes Paris-Sharing.com to secure a deposit authorization equal to four times the price per night, with a minimum of 500€. Some or all of this deposit may be used in case of any damages caused by the renter to the apartment or to any of its furnishings during the stay.

The deposit authorization will be dropped at the latest two weeks following departure, provided the Owner and the Renter agree that no damage has been caused. In case of a damaged or missing item that has been replaced by the Renter, the deposit will also be returned in full.

In the case of damage, the Owner will withhold the amount deemed necessary for repair or replacement, based on material evidence. If the actual amount for the repairs is less than the estimate, the Renter will receive reimbursement for the difference. Some damages may be covered by the Renter’s insurance policy, and will be reimbursed according to the terms of that policy.

 

As it is expected that the apartment be rendered clean (waste bins emptied, dishes, appliances and toilets cleaned), the amount of 25€ or 50€ may be deducted in case any or several of these tasks have not been carried out, and / or if the premises are left requiring more than standard housecleaning.

There is a 200 EURO charge for replacing a lost apartment key. Please keep your key with you at all times. There is a 100 EURO fee for a lost magnetic entryway key for the building.

Amenties & Supplies

The apartment is equipped with: tableware, glassware, cookware, and cooking utensils. Beginning supplies of toilet paper, dish soap, hand soap, and garbage bags are supplied to get you started; however, they will not be re-supplied during your stay. We provide the following linens: Bed sheets: fitted sheet, duvet cover, pillowcases Dishcloths Bath towels

Telephone use

We will verify your phone bill before your departure. Calls to landlines in France, the UK, the continental US (as well as 45 other countries—inquire for details) are free of charge. Calls to mobile phones and special numbers will be billed to the tenant and deducted from the security deposit.

Check-in and check-out

In order to avoid misunderstandings about any damages observed after the stay, both parties will agree upon arrival to the state of the premises and to the inventory of furnishings. Observations may be made at the bottom of the present agreement, or on an attached document. If the owner is aware of any existing deteriorations, these should be indicated in advance within a special document. If no such observations are made, the premises are considered to be handed over in good condition, and it is expected that they should be rendered as such. Should the renter notice any broken items or deteriorations subsequent to check-in, these should be reported to the owner or to welcome@parisharing.com within 24 hours.

 Signature of the present signifies each party's agreement regarding the state of the premises.

Check-in and check-out times are flexible, but must be pre-arranged with the owner or his agent. In the absence of such arrangements, the check-in time is set between 2 and 3pm, and check-out between11am and noon. Check-in/check-out before 8am or after 8pm may be subject to a surcharge of 30€.

Falsified reservations

Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in. ParisSharing reserves the right to verify the renter’s passport identity.

General Conditions

The renter agrees to these conditions:
  • Not to use the apartment for commercial purposes
  • To keep noise levels to a minimum. You are renting in a strictly residential area. Quiet hours are between the hours of 10 p.m. and 8 a.m. weekdays and 11 p.m. and 9 a.m. weekends. Tenant(s) understand that if the Owner, or the Police department, is called with complaints of noise or any other violation set forth by the City of Paris Laws, tenant(s) may be asked to vacate the premises immediately, forfeiting all rental moneys and deposits.
  • To modify neither the apartment nor the furniture
  • To authorize the Owner to perform emergency repairs during the duration of the agreement without requesting any indemnity.
  • To assume liability for content downloaded using the apartment’s secure internet access.

    The terms of the present agreement are considered to be tacitly accepted by both parties upon reservation. Manual signature of this document will serve as proof of check-in and acceptance of the state of the premises.

     In the unlikely case where disagreements cannot be arbitrated between the parties, the matter will be brought to the local court presiding over the rented property’s jurisdiction.
